Consumers who bought certain Bestway above-ground pools may qualify for cash from a proposed $15 million class action settlement. The case concerns pools 48 inches or taller with compression straps running outside the vertical support legs, including certain Power Steel, Steel Pro, and Coleman Power Steel models.
The lawsuit alleges the exterior straps can create a foothold that allows young children to climb into the pool. Bestway denies that the pools are defective and denies wrongdoing.
Who Can File a Claim?
You may qualify if you:
- Bought a Bestway-branded above-ground pool that is 48 inches or taller.
- Bought a model with compression straps located outside the support poles.
- Purchased the pool for personal use and not for resale.
- Bought it new from a retailer rather than secondhand.
- Purchased it in the United States, a U.S. territory, or the District of Columbia.
- Bought the qualifying pool before May 4, 2026.
Covered models were sold from 2008 through 2024. Examples identified in the settlement materials include Power Steel, Steel Pro, and Coleman Power Steel pools.
Only one claim is allowed per household.
How Much Can You Get?
The payment depends on whether you submit valid proof of purchase.
- With valid proof of purchase: You can receive 10% of the actual purchase price shown in your records. If the documentation identifies the pool but does not show what you paid, the payment can be based on 10% of the average retail price for that product.
- Without valid proof of purchase: You can receive $40.
Payments may be reduced proportionally if approved claims exceed the amount available after permitted settlement costs.
What Counts as Proof of Purchase?
Proof is not required for the $40 payment.
To qualify for the 10% payment, the settlement administrator requires objectively verifiable purchase documentation, such as a store receipt, online receipt, or another contemporaneous record showing the qualifying purchase.
Claimants without proof must still provide identifying information about the pool, including the brand, dimensions, model or serial number, approximate purchase date, retailer, and confirmation that it was purchased for personal use.
The settlement administrator may request additional information while reviewing a claim.

The hearing is scheduled before Judge Lindsay C. Jenkins in the U.S. District Court for the Northern District of Illinois. The court may change the date, time, or format.
When Will Payments Be Sent?
There is no fixed payout date. Payments can be distributed only after final approval becomes effective and any appeals are resolved.
Why Is There a Bestway Pool Settlement?
The lawsuit alleges certain Bestway above-ground pools have a design that creates a potential drowning hazard because an exterior compression strap can function as a foothold.
Plaintiffs also alleged that the voluntary recall announced with the U.S. Consumer Product Safety Commission did not provide a monetary remedy to pool owners.
The parties reached the settlement after mediation rather than continue litigating the case.
The Settlement Is Separate From the Pool Recall
The class action settlement does not replace or limit the July 21, 2025 CPSC recall.
That recall covers certain 48-inch-and-taller above-ground pools from Bestway, Intex, and Polygroup with compression straps running outside the support legs. CPSC said the straps can allow a child to climb into the pool even when the ladder has been removed, and announced a free repair remedy for affected owners.
