CVS Pharmacy is one of the largest retail pharmacy chains in the United States. Criteo Corp. is a digital advertising company that provides advertising technology and related services. The lawsuit alleged that technology embedded in CVS digital properties disclosed health, personal, browsing and other information about users to Criteo or other third parties without proper authorization.
CVS and Criteo deny the allegations and deny that they violated the law. They agreed to a proposed settlement with a maximum cash payment of $20.5 million to resolve the case without a trial or admission of liability.

The words up to matter. The $5 and $10 amounts are not guaranteed minimum payments. If the total amount needed for valid claims and other settlement costs exceeds the money available, payments are reduced pro rata.
The $20.5 million is also not a fund reserved entirely for consumers. The maximum cash payment covers valid class member payments, settlement administration, court-approved attorneys’ fees and costs, and service awards to the class representatives.
Class counsel may ask the court for fees, costs and expenses of up to 37.5% of the maximum cash payment, or $7,687,500. The class representatives may request service awards of up to $2,500 each.
If money remains after valid claims and the other settlement obligations are paid, the agreement provides for residual funds to revert to CVS and Criteo rather than automatically increasing payments to people who filed claims.
Who Qualifies
The settlement class generally includes living individuals who accessed a CVS digital property in the United States before July 27, 2026.
Covered digital properties include CVS.com, CVSHealth.com, the CVS mobile app and other CVS digital properties covered by the settlement.
A purchase is not required.
Someone who visited a covered CVS website or used the CVS app before the cutoff date may qualify even if they never completed an online purchase. A purchase made only at a physical CVS store does not by itself establish that the person accessed a covered digital property.
The settlement limits cash recovery to one payment per household. A household is based on the same mailing address, so multiple people living at one address do not each receive a separate payment.

December 1, 2026 at 9:30 a.m. Eastern. Final approval hearing. The hearing is scheduled to take place virtually by Zoom. The date or time can change.
How and When You Get Paid
Claims can be submitted online through the official CVS Digital Privacy Settlement website or by using the paper claim process provided by the settlement administrator.
Some class members received a notice with a Login ID and PIN. People who did not receive those credentials can still use the settlement site’s claim process if they otherwise qualify.
Payment options include PayPal, Venmo, Zelle or a paper check.
Payments are not immediate. The settlement must receive final approval and any appeals must be resolved before distribution. The settlement materials provide for payments to approved claimants after the settlement becomes final.
Paper checks expire after 180 days.
