What Is the Excel Fitness Settlement?
Excel Fitness Consolidator, LLC, which does business as Excel Fitness Management, has agreed to a proposed settlement in a data-breach class action.
Excel Fitness is an independently owned Planet Fitness franchisee based in Austin, Texas. The company says it operates more than 180 Planet Fitness locations across nine states.
Who Is Eligible?
The settlement covers current and former Excel Fitness employees living in the United States whose personal information was potentially accessible during the January 2025 data incident, including people who received notice of the breach.
Excel Fitness, its officers, directors and related companies are excluded, along with the judge and the judge’s family and staff.

How Much Money Can You Get?
Option 1: About $50 With No Proof
You can claim a one-time alternative cash payment expected to be $50.
No receipts, bank statements or explanation are required for this option.
Choosing the alternative cash payment means you cannot also claim the documented-loss or lost-time cash benefits.
Option 2: Up to $4,000 for Losses and Lost Time
Class members can instead seek reimbursement for qualifying losses tied to the data incident, including:
- unreimbursed fraud or identity-theft losses
- credit report or credit-monitoring costs
- fees related to freezing or unfreezing credit
- replacement identification costs
- postage used to contact financial institutions
The losses must have occurred between January 17, 2025 and September 21, 2026. Expenses already reimbursed by another source are not eligible.
Class members can also claim up to three hours of lost time at $25 per hour, for a maximum of $75. The official online claim form states that lost-time and out-of-pocket benefits are combined under the $4,000 maximum.
Documented-loss claims require supporting records such as bank statements or receipts. Lost-time claims require an attestation that the time was spent responding to the incident.
Two Years of Credit Monitoring
Class members may also enroll in two years of CyEx Financial Shield Complete.
The service includes $1 million in identity theft insurance and access to a fraud-resolution agent if suspicious activity occurs.
This benefit can be claimed in addition to the cash option you choose.
Is There a Limit on Settlement Payments?
The settlement places a $175,000 aggregate cap on the covered cash benefits.
If approved claims exceed that amount, each cash payment will be reduced proportionally.
Class Counsel separately plans to ask the Court to approve $150,000 in attorneys’ fees and litigation costs and $3,000 service awards for each of the two class representatives. The official settlement FAQ says Excel Fitness will pay those amounts separately.
How to File a Claim
Claims can be submitted through the official Excel Fitness Data Settlement claim page.
To start an online claim, the settlement website requires the Login ID and PIN from your notice. If you lost them, the administrator says you can request them by providing your full name and mailing address.
A paper claim form can also be submitted by mail or email.
The claim deadline is September 21, 2026. Online and emailed claims must be submitted by that date, while mailed claims must be postmarked by September 21.
What Happened in the Excel Fitness Data Breach?
According to the settlement website, Excel Fitness discovered a targeted cyberattack on its computer systems in January 2025.
Files accessed during the incident may have contained information including names, addresses, email addresses, phone numbers, dates of birth, financial account information and Social Security numbers.
The plaintiffs allege that Excel Fitness failed to properly secure and safeguard the private information involved in the incident. Excel Fitness denies wrongdoing, and the Court has not decided which side is right.
When Will Payments Be Sent?
There is no payment date yet.
The Court is scheduled to hold the Final Approval Hearing on February 4, 2027 at 1:30 p.m. Central Time in the District Court of Oklahoma County, Oklahoma.
Settlement benefits will be distributed only if the Court grants final approval and after any appeals are resolved.
What Happens If You Do Nothing?
If you do nothing, you will not receive cash or credit-monitoring benefits from the settlement.
If you did not opt out by August 21, 2026, you will still be bound by the settlement and give up the right to pursue the released claims against Excel Fitness on your own.
